GENERAL CONDITIONS - SERVICE DELIVERY
The conditions set forth below are intended to be accepted by the customer by the mere fact of
signing the quote, or acceptance of the invoice.
The agreements will be recorded in writing otherwise, regardless of the amount of the invoice.
1. Service delivery:
Caradise VIP proposes, inter alia, the following services:
- VIP car rental with driver for trips to Belgium and abroad,
- Delivery of documents or property, in Belgium or abroad,
- Escort clients when traveling by train, plane, abroad.
2. Orders:
The company may accept or decline orders received. Acceptance will be presumed to benefit
the company. Prove the customer's acceptance or rejection in writing.
In case the parties agreed on a deposit, the order will become upon receipt by the company of
the deposit. Similarly, if the customer has committed to provide the documents or company
property, the order will become final upon receipt thereof. Any change of reservation or delivery must
be indicated by the customer as 48 hours before the start of the service.
In case of change of reservation after delivery or signature of the estimate, a extra cost can be claimed.
No cancellation of orders will be accepted running.
3. Price:
Prices are charged on the basis of rates established by the company.
A deposit of 50% of VAT may be required when signing the quotation or supply.
It will be stipulated in the quotation. Prices shown in our prices excluding VAT. For transport services,
prices also include chauffeur service, the fuel and insurance law. Tolls, parking fees, meals and accommodation are possible for the driver to charge of the customer, unless otherwise stipulated in the quotation. Meals and accommodation of any persons carried are charged to the customer.
4. Transport:
Subject to legally required insurance for the company, the transport of people and goods or materials
is at the risk of the customer. If delivery of goods or documents, the corporate responsibility ceases
when the arrival thereof at the destination.
In case of transport of persons, baggage is accepted in the 30 kg
person transported. Baggage remains in the custody of the person transported.
The carrier reserves the right to cancel a service if weather conditions fail to deliver in safe conditions
(snow, ice, ...). In this case, the customer will have the option to defer delivery on a date
later or cancel the order and recover his deposit.
The company's drivers are required to respect the Highway Code in force in the or the countries visited.
Under no circumstances the client may require it to violate these rules,
even if this would cause delays or additional costs for any the client.
5. Payment:
Payments are due within 30 days of sending the invoice.
Any amount not paid when due is productive, automatically and without prior notice, a 12% interest.
Non-payment of an invoice at the due date results in the addition due, as of right
and without notice, to pay liquidated damages of 15% of the invoice amount excluding VAT,
with a minimum of 50 EUR. Non-payment of an invoice also gives the right to suspend the execution of orders.
In this case, the company can not be held responsible for possible consequences due
to the suspension of benefit and will not be required to payment of damages.
6. Complaint:
All claims must be received by the company, under penalty of forfeiture, by registered mail return
receipt requested, within 15 days of receipt of the invoice. The customer is not entitled to withhold payment
until the company does not recognize the merits of his claim.
7. Various:
If one or more provisions of this convention is inapplicable, for a whatever reason, the remaining provisions still apply.
8. Competence:
In case of dispute, and whatever the cause, the courts of the District Brussels are competent, even in case of
warranty claim, lis pendens and connectedness. The company shall have the option to waive this provision.
The law is applicable Belgian law, excluding international conventions. However, when the contract is concluded with a consumer, the law remains application.
